What is a paternity test?
When the paternity of a child is in question, a simple paternity test can be given to the child and potential father. Because blood types alone can only determine the possibility of biological fatherhood, a DNA test must be administered to ensure paternity. If every DNA probe from the child and potential father match, paternity is 99.9% positive.
Can the Courts order paternity tests?
During a Court case, a person whose paternity is in question may request to the Court for leave to obtain blood tests to establish paternity. If the Courts believe that the paternity test is a necessity in the case, leave will be granted. In the event that a person refuses to submit to blood tests recommended by the Court, he will not be found in contempt of Court; but the Court will draw an adverse inference from the refusal. Based on the determination of the paternity testing, a person may or may not be required to pay child support.
Limits to paternity testing in Court cases
In any Court case involving parents and children, the child’s best interest is always the top priority. If access to the child will be determined by the results of a paternity test, the Court may not admit them. Biological fatherhood is not as important as the relationship that may have already been formed between parent and child. In cases of child support, the father does not have to be biological if he has acted as a parent for long enough.
