George, a young man with no previous criminal record, came to Irving Solnik for help when he was accused of two very serious criminal offences. While working part-time with computers and information technology as he studied for his master’s degree at York University, George found himself in an unenviable position. His girlfriend (Nichole) of almost 10 years accused him of criminal assault and theft after a heated argument the two shared in her parent’s home. While the couple had argued, at no point did George physically assault Nichole. As for the cell phone, George looked at it to see who she was calling, but left the phone in her home before he left. He did not steal it.

While driving to his own home after the argument, George received a phone call from Nichole’s mother telling him that police were at their house looking for him and he should return. George did so.

George was immediately arrested when he arrived at the home of Nichole’s parents. He was handcuffed and taken into the basement for questioning. George was forced to stay in the basement for several hours before being taken to jail.

Despite Nichole’s mother telling the police what had actually happened and explaining that no criminal offence had taken place, George was still arrested. The mother was told to keep quiet and that she was a “bad mother” for standing up for George instead of her own daughter.

Upon arrival at the police station several hours later, George was put in a holding cell for several more hours before he was able to sign a peace bond and be released upon the condition that he would not contact Nichole or her parents. A Court appearance was scheduled for several days later.

When George came to Irving Solnik, Irving immediately realized the police had grossly over-reacted to the situation. George, a Master’s student and citizen in good standing with the community, was treated like a dangerous criminal or terrorist when he was arrested by six heavily armed SWAT Team members. Could it be that George’s Iranian/Moslem heritage had something to do with this?

To handle this case, Irving Solnik did not rely on the tried and true strategies and tactics that had enabled him to be successful in the past for similar domestic issues—because this case was different. Instead, Irving Solnik developed a unique strategy and blitzkrieg tactic to successfully get the charges dropped against George.

To begin with, Irving Solnik advised George to not do or say anything until told otherwise. As Irving Solnik entered the courtroom and signed in as counsel, he asked one of the Crown attorney’s assistants to prioritize his case over the many others to be heard that day. Though she did not seem too eager to help, George’s case was the second one heard that day.

Upon being called, Irving Solnik immediately asked for a pretrial. He asked if there were anymore disclosures of which he needed to be aware (there were none) and pressed for a pretrial to be held as soon as possible.

The pretrial came quickly and Irving Solnik was able to poke holes in the Crown’s case against George. He pointed out how a minor incident between two people barely out of their teenage years had been grossly mishandled. He was also able to obtain signed statements from Nichole and her parents refuting the criminal charges against George.

The Crown attorney was embarrassed, but still wanted George to pay $1,000 to a charity of the Crown’s choice in exchange for dropping the charges. Through careful negotiation, Irving Solnik was able to reduce this amount to $400.

By unexpectedly asking for a pretrial and having witness statements prepared and signed for the Crown attorney to read, Irving Solnik was able to protect George from a gross injustice. These actions are not typical of defence lawyers, but Irving Solnik decided that it was in the best interest of his client to take these measures. In less than three weeks, Irving Solnik was able to have the charges withdrawn against George!
